Residents approach HCM City party chief in building dispute

350 households in The Everrich Apartment Building in HCM City have sent a letter to the city's Party Secretary Dinh La Thang to resolve disputes with the building's investor.

Phat Dat Real Estate Development Corporation is accused of failing to meet its promises and violating the residents' rights.

According to the letter, in June 2006, Phat Dat Corporation widely promoted the new project with promises about swimming pool, spa and common room. However, since 2009, when the project completed and residents started moving in, the pool area has been minimised and the gym rented out as office space.


In May, the households said they found out that the investor didn't publicise or manage the maintenance fees in accordance with regulations. The fees are collected by the investors and later transferred to the management board. However, Phat Dat hasn't transferred all of the money. Many spaces or services are sold or used for other purposes.

"We feel insecure. We have lost trust in the investor. If the violations are not dealt with then our rights will continue to be violated," a representative for 350 households said.

Phat Dat Corporation said only a small number of new households had made complaints and that they did not represent all 350 households. Phat Dat only keeps the maintenance fees temporarily until a new management board has been decided. The location of the common room hasn't been changed as drawn in the construction drawing.

"The spaces are ours and we give priority to our residents if they want to rent it to open a gym. But no one wanted to so we rented it to other parties," said Bui Quang Anh Vu, deputy director of Phat Dat Corporation.

In their notice, Phat Dat claimed that they have always put residents' interests first and hadn’t violated the contracts.
