Four cases subjected to environmental compensation

The Government has adopted Decree 113/2010/NĐ-CP, stipulating four cases subjected to environmental compensation.

These cases include:

1- Water sources for preservation, people’s daily use, entertainment, production and other purposes that are seriously or extremely contaminated.

2- Land environment for preservation, production, and other purposes that is seriously or extremely contaminated.

3- Natural eco-systems that are degraded.

4- Species (prioritized for protection under legal regulations) that are killed or injured.

The identification of damage includes collecting data and evidence, calculating damages to the environment, and defining responsibilities of offenders.

People’s Committees at all levels and the Ministry of Natural Resources and Environment have the right to order offenders to compensate for damages to the environment.

The offenders must pay full compensation and calculation fees.

The Decree is not applicable in case of natural disasters, force majeure and other situations stipulated under legal regulations.
